PLEASE NOTE: Whimsy Doodle Graphics is a licensed reseller for ALL ARTISTS here in our store, and we DO NOT own THEIR artwork. Therefore, we must follow ALL ARTIST'S TOU (as does anyone selling any artist's work).

Never ASSUME you can do what you want just because we don't list it.  CHERYL SESLAR'S TOU are a bit different then all the other Artist's I carry (including myself). Please read her TOU below also.

A NOTE ON SHARING/FREEBIES:

NOTE THIS RULE:  Rule No. 2 was CLARIFIED in my terms of use below.  This rule has always been in effect, only I hadn't written it in the terms because I had no idea it was something people were doing. 

So the terms haven't changed, but they were updated to include this specific information. We cannot KNOW everything that everyone would possibly want to do with what they buy from us.....EMAIL us if you do not see what you want to do with our items, do not EVER assume that just because we do NOT list it, it means you can do it! Thank you.

SHARING/FREEBIES:

1. You  may NOT sell or give away the clip art “as is”.
2. You may NOT share or give away any  You may NOT make printables,scrapkits, web sets, etc. and share or give them away in any online or offline groups  or forums.  

3.You MAY ocassionally use what you make as a freebie, sample, or business promotion or share what you make, but it must be from your own website or blog ONLY promotion unless you have requested special written permission for any
other areas not listed.  This helps protect those who run a business trying to sell printables, scrapkits, web sets,  incredimail stationery
and other things. The reason being, there aren't so many freebies floating around, you will be able to sell more.

4. YOU MAY use the free clipart or pattern I post on my free clipart image or free pattern page to create things and share them though..

 I've tried to make the rules easier to understand by doing FAQ in Question and Answer form.

PERSONAL AND COMMERCIAL USE RULES:

*. You MAY NOT resell anything “as is” - You must create something new with what you buy and cannot give them away.
*  You MAY NOT colorize the clipart or patterns and sell them as clipart.
*We reserve the right to create collections in various colors. Plus we carry the work of other artists who prefer that recolorizing isn't done.
*  You MAY NOT create other commercial use products (ONLY pertains to digital scrapbooking designer resources/tools)
*  You MUST create something new with what you buy, that you intend to sell or use for your own personal use ONLY.

~NOW FOR THE  RULES IN QUESTION AND ANSWER FORM:

QUESTION: Are any of your items you sell in EMBROIDERY FORMAT?

ANSWER:    NO, they are NOT. The only FORMATS we carry are in either GIF,JPG or .PNG format only.

If you want to digitize the items you buy from us and sell them as patterns, you may. But they MUST be digitized. If  you need someone to digitize them for you because you do not digitize, we do have a "Digitizers for Hire" page. You can find that link on the mainpage of our store. If you choose to use one of the gals on that page, please contact the person and inquire about their fees and such before you buy from us. ****If you do not need anyone's service for digitizing, THAT IS FINE TOO!

You are NOT required to use the people on that page! That page is only there for people WHO DO NEED someone to digitize your items for them!

QUESTION:  Can I create printables, websets, scrap kits, overlays, papers, web graphics and sell them on my own website, eBay or Etsy?

ANSWER:   YES YOU CAN!

QUESTION:  Can I use your scrap kits, papers, elements and such to design layouts, websets, or printables (no sharing) for myself or a client?

ANSWER:  YES YOU CAN,  but you must add things of YOUR OWN to them (You CANNOT use just the items you buy from us you must add your own things).

QUESTION:  Can I use the clipart you sell to make brads, overlays, elements, paper packs, stickers and such  for my scrapkits to sell or use as personal use?

ANSWER:  YES YOU CAN! AS LONG as you don't use just the items you buy from us. You MUST add your own things to what you create and sell! It CANNOT be just our items.You can create scrap papers with these as long as you are selling them for PU/S4H/S4O or your own personal use.

QUESTION: Can I use your clipart for making crafts that I sell online or at crafts shows and such or use it as personal use?

ANSWER: YES YOU CAN! AS LONG as you don't use just the items you buy from us. You MUST add your own things to what you create and sell! It CANNOT be just our items.

QUESTION: Can I use your clipart for S4H/S4O Scrap Graphics?

ANSWER:   Yes! You may use the clip art to create something new (such as taking a piece of clipart and making a sticker,brad, element, and such) for your scrap kits, paper packs or element packs to sell or use for personal use as long as they are sold PU/S4H or S4O.  You must also, ADD your own items to what you make to sell, you can't use jsut the items you buy from us.

QUESTION: Can I use the printables or crafts I make  with your items for personal use and to sell online or at craft shows?

ANSWER: YES YOU CAN! (this includes your own website, Ebay or Etsy and Multi Vendor sites. Please see Cheryl Seslar's Rules about Multi Vendors if using her items). You MUST give us credit in a clickable link form if online, or at least www.whimsydoodlegraphics.com.

QUESTION: Do I have to save the things/creations I make a certain way?

ANSWER: YES, you do,  your creations must be saved as ONE layer so it cannot be edited by others you sell to and you can save it as transparent PNG.

QUESTION: Do I have to give credit if use your items to create things to sell?

ANSWER:  YES you do.  You MUST provide a clickable link to our store (if possible) and link it to www.whimsydoodlegraphics.com and also mention the original artist. Pick one of the following ways to do it:

Credit in your artist's credit/credit page or
Credit on your Mainpage.

****IT IS NOT OK to just add the credit to the TOU file you include in the zip file. It must be one of the 2 ways we listed.

As far as crediting the original artist too, all you need to do, to find out which artist to credit is look at the product description of the item you are using in your creation. 
We know that the mass majority of our customers are honest.  Thank you for respecting out our rules and the artist's rules on this.

QUESTION: Can I use your items to create things for my Cafepress or Zazzle store?

YES! You can use our items for things you make/create for products in your Cafepress and Zazzle store! BUT you MUST create something NEW with the items you buy. Just be sure that WHAT YOU CREATE isn't AGAINST CAFEPRESS AND ZAZZLE'S
TOU!   ***Cheryl Seslar has different rules on this, so if you have her artwork, please refer to her TOU.

 Again, please credit us with a clickable link in your store ( I have stores there so you are able to do that).

QUESTION: What are your rules for Embroidery?

ANSWER:   The rules for Embroidery Use are simple:

1. You MUST credit us somewhere that it is obvious to people if you digitize our items and sell them as patterns.
Be sure the credit is not hidden somehow, make it obvious. Credit us with "www.whimsydoodlegraphics.com" and a clickable link if possible.

2. You are allowed to sell the items you buy from us as patterns, BUT you MUST digitize them 1st,  no exceptions.
3. You cannot include the original file you bought from us ever in any way.
4. You cannot give away the patterns you buy to anyone or any group even if they are digitized.
5. You may occasionally offer a pattern you digitize as a freebie, sample, or business promotion, but it must be from your own website or blog ONLY and must credit us and the artist. No exceptions. The pattern MUST be digitized before you offer it.
6. You MUST give us the link to your store, if you digitize our items and sell as patterns. PLEASE BE SURE TO SEND US YOUR FULL URL!

CHERYL SESLAR DESIGNS TERMS OF USE

Please notice there are different terms for Non-Exclusive verses Exclusive and Special Edition Clip art.) 

If you own Cheryl's Commercial license, you CAN use either the Non-Exclusive or Exclusive and  Special Edition collections on your Cafe Press / Zazzle stores. 

NEW! You can also purchase Cheryl's NEW Multi-Vendor license that will allow for you to sell on 1 multi-vendor website for any of the clip art I carry (refer to her license for more information).

*****Non-Exclusive Clipart Collections:

Are for PERSONAL USE ONLY unless you have one of Cheryl's COMMERCIAL USE LICENSES.

You MAY:  Create things for your own PERSONAL USE. Those things can include your own printables, blog design, or website, you'd personally use, scrap kits and such. Everything you create must be used just for your own use UNLESS you own Cheryl's
COMMERCIAL USE license.

You may NOT:  Sell any items you create with the PERSONAL USE clip art or give away for free anything you create/make via groups or forums.

If you purchase or own one of Cheryl's Professional Licenses or Cheryl's Commercial License, then you can use the NON-Exclusive
clip art collections for commercial use (as pertains to whatever license you own according to Cheryl's terms of use on her site for each license).

****Exclusive/Special Edition Clipart Collections:

Revised Terms of Use (August 10, 2009):
You can now use any of the Exclusive/Special Edition Cheryl Seslar Designs for CU/S4H/S4O/PERSONAL (some restrictions apply)!

You MAY:

Create printables, scrap kits, web graphics and sell them (not give them away) on your own website, eBay or Etsy.
The items you create CAN be sold on a CD or as a download as long as it's your own website, eBay, or Etsy.

NEW!!!! You can purchase Cheryl's NEW Multi-Vendor license that will allow for you to sell on 1 multi-vendor website (refer to her license for more information).

You MAY NOT:

Sell or give away anything you create at online craft malls or multi-vendor websites as not to flood the market (per Cheryl Seslar).
You MAY NOT give away for free any creations you make via groups or forums.  You MAY give away the occasional sample via your own website or blog.

You MUST credit Whimsy Doodle Graphics (www.whimsydoodlegraphics.com) and mention Cherylo Seslar too.

No vulgar, sexist, racist, hate, porn, child porn or anything else in between and not listed can be made from ANYTHING we sell.

ANYONE with any of those intentions now or ever....ARE NOT allowed to purchase from us. EVER.  Even if you do not have intents at the time of purchase, but decide you do after you purchase....YOU STILL CANNOT USE ANYTHING WE SELL!  We do not allow refunds of any kind for any reason. If it could be even POSSIBLY misinterpreted as what we outlined above, YOU CANNOT USE ANYTHING WE SELL OR BUY FROM US!

REFUNDS:

Due to the nature of our business, we cannot offer refunds of any kind on anything bought in our store . Customers cannot physically return our products therefore we cannot issue refunds or store credit.  So please be sure to read the Terms Of Use/Conditions Of Use and the Product Descriptions before placing your order to eliminate any errors you may make in purchasing.

PIRACY REPORTING

Please help us to stop piracy, report any suspicions! Your name will be kept private, always! Even if you're not sure, please let us look into it as we have records of what people buy.
